Cargo Cycling / Nijland Cycling B.V. – Chariot FS2 Cargo Trike Warranty Policy

1. Warranty Coverage:
Cargo Cycling / Nijland Cycling B.V. (“Cargo Cycling”) is committed to providing high-quality products. We stand behind the Chariot FS2 Cargo Trike (the “Product”) and offer this Warranty Policy to ensure your peace of mind. This Warranty Policy covers manufacturing defects in materials and workmanship for a specified duration from the date of purchase, subject to the terms and conditions outlined below.
2. Warranty Duration:
The “Product” comes with a limited warranty. The duration of the warranty depends on the specific components of the vehicle:
- Frame: Five (5) years from the date of purchase.
- Non-electric Components: Two (2) years from the date of purchase.
- Electric Components: One (1) year from the date of purchase.
- Wear and tear parts: see paragraph “6. Limitations and Exclusions”
3. Warranty Eligibility:
To be eligible for warranty coverage, you must meet the following criteria:
- The Product must have been purchased from an authorized Chariot dealer or directly from Cargo Cycling.
- The Product must be used in accordance with the manufacturer’s instructions and guidelines.
- The Product must not have been altered, modified, or tampered with in any way.
- Parts used for maintenance, service and repairs must be approved by Cargo Cycling.
- The Product must not have been involved in accidents, collisions, or other events that may cause damage not related to manufacturing defects.
4. Warranty Claims:
In the event of a potential warranty claim, please follow these steps:
- Contact Cargo Cycling’s Customer Service team at firstname.lastname@example.org.
- Provide proof of purchase, including the date and location of purchase, as well as any relevant documentation.
- Describe the issue or defect in detail, including any photographs or videos if requested by Cargo Cycling or its authorized service partner.
5. Warranty Resolution:
Cargo Cycling, or its authorized service partner, will evaluate your warranty claim and, if deemed eligible, will provide one of the following resolutions:
- Repair: Cargo Cycling, or its authorized service partner, may choose to repair the defective part or replace it with a new or refurbished part, at our discretion.
- Replacement: If the defect cannot be reasonably repaired, Cargo Cycling, or its authorized service partner, may replace the entire Product with a new or refurbished one.
- Refund: In rare cases where neither repair nor replacement is feasible, Cargo Cycling, or its authorized service partner, may offer a refund for the purchase price of the Product.
6. Limitations and Exclusions
- Wear and Tear Parts Warranty:
- Cargo Cycling recognizes that certain components of the Product, such as tires, brake pads, cables, and chains, are subject to normal wear and tear during regular use. While these parts are not covered under the standard warranty, we offer a limited warranty for wear and tear parts as follows:
- Duration: The warranty for wear and tear parts is valid for two months from the date of purchase.
- Coverage: Cargo Cycling, or its authorized service partner, will replace or repair, at our discretion, any wear and tear parts that fail to function as intended due to manufacturing defects during the warranty period.
- Exclusions: This wear and tear parts warranty does not cover damage caused by misuse, neglect, accidents, or any alterations made to the Product. It also does not cover normal wear and tear that occurs during regular use.
- Claim Process: To make a wear and tear parts warranty claim, please follow the same steps outlined in Section 4 (Warranty Claims) of this policy.
This wear and tear parts warranty is designed to provide additional assurance to our customers for the specific components that naturally wear out with regular use, ensuring your continued satisfaction with the Product.
This warranty does not cover:
- Damage caused by misuse, neglect, or improper maintenance.
- Cosmetic damage that does not affect the Product’s functionality.
- Any modifications or alterations made to the Product.
- Any damage caused by non-authorized repairs or parts.
Only the first owner is entitled to warranty; warranty is not transferable
7. Limitation of Liability:
Cargo Cycling’s liability under this Warranty Policy is limited to the repair or replacement of the Product as outlined herein. Cargo Cycling shall not be liable for any indirect, consequential, or incidental damages.
8. Governing Law:
This Warranty Policy is governed by the laws of The Netherlands, without regard to its conflict of laws principles.
9. Changes to Warranty Policy:
Chariot reserves the right to update or modify this Warranty Policy at any time. Any changes will be effective upon posting on the Chariot website or providing notice to customers.
